What happened
KFF's tracker of state abortion laws, updated October 16, 2026, counts 13 states where abortion provision is banned and 6 states with gestational limits between 6 and 12 weeks in effect; 5 of those states have no exception for the pregnant person's health, 8 have no exception for rape or incest, and 11 have none for a fatal fetal anomaly [1].
On November 3, 2026, voters in four states decide abortion measures directly: Idaho's Proposition 1, Nevada's Question 6, Virginia's Question 1 and Missouri's Amendment 3 [2].
Why it matters
Three of the four measures would establish or protect a right to abortion in state law; Missouri's Amendment 3 runs the other way and would overturn the constitutional right Missouri voters approved in 2024, prohibiting abortion except in cases of medical emergency, fetal anomaly, rape or incest [2].
In those four states this is one of the few questions on the 2026 ballot where the vote is on the issue itself rather than on a candidate [2].
The evidence
Idaho's Proposition 1 would create a statutory right to reproductive freedom and privacy and bar the state from restricting abortion before viability, opening a legal route to challenge the state's total ban; Nevada's Question 6 is the second of two required votes to put a right to abortion in the state constitution; Virginia's Question 1 would enshrine a right to reproductive freedom covering contraception, abortion, pregnancy loss and fertility care [2].
KFF's counts are of laws in effect, not laws passed and enjoined, and the tracker notes that exceptions vary in wording and in how physicians read them [1].
Response and counterpoints
Supporters of the bans argue that the exceptions written into them are adequate and that the question belongs to state voters and legislatures after the Supreme Court's 2022 decision; Missouri's measure is itself an example of voters being asked to reverse an earlier vote [2].
What remains uncertain
Court rulings can change which laws are in effect between KFF's October 16 update and Election Day [1]. Nevada's amendment, if approved, takes effect only after a further step described by Guttmacher, and Idaho's measure is statutory, so a future legislature could amend it [2].
